Christian Ministry sues Biden Admin for rules forcing them to pay for gender transition surgery

A Christian organization is suing the Biden Administration over its mandates that force religious nonprofit and for-profit employers to pay for or perform gender transition surgeries, procedures, counseling, and treatments.

The organization, Christian Employers Alliance, filed the suit saying that the mandates from the administration are a violation of their religious beliefs.

Christian Employers Alliance is being represented by the Alliance Defending Freedom attorneys, who filed the suit in federal court on Monday.

ADF also filed a motion on Tuesday asking the court to halt the enforcement of these mandates immediately.

ADF Senior Counsel Matt Bowman shared the stance of his clients and their religious belief on sexual identity and that they aren't alone in their views.

"Many religious employers—including the Christian Employers Alliance and all of its members—hold sincere beliefs that gender transition surgeries and procedures are morally wrong and contradict their beliefs that God purposefully created humans as either a biological male or female and that a person's biological sex is immutable," Bowman said, CBN News reported.

The lawsuit claims that the Equal Employment Opportunity Commission is misinterpreting and improperly enforcing discrimination based on sex in Title VII when they force religious employers to pay for and provide health insurance coverage for gender transition surgeries and procedures.

"By misinterpreting and improperly enforcing federal law, President Biden has far overreached his constitutional authority, to the detriment of people of faith across the country," Bowman said, CBN News reported.

The lawsuit also challenges the U.S. Department of Health and Human Services' change of how "sex" is interpreted in federal law to include gender identity.

By doing so, religious healthcare providers say it forces them to physically perform or facilitate gender transition surgeries and procedures, contrary to their deeply held beliefs.

The lawsuit will look to stop mandates by the federal government and allow those who share different beliefs to deny such treatments and surgeries.

"The government cannot force Christian employers to pay for, or physically perform, harmful medical procedures that contradict their religious beliefs," Bowman said. "The Constitution protects religious healthcare providers and employers and allows them to go about their work in a manner compatible with their deeply held convictions and faith."
