Idaho dad won't face death penalty for gunning down neighbor's family after teen flashed daughter

As the case against an Idaho father charged with the murder of his neighbors continues, it appears that prosecutors will not seek the death penalty.

Majorjon Kaylor, 31, was arrested June 18 and he has been charged with four felony murder charges and one felony burglary charge, according to court records. These records also show that subpoenas in the case were issued this week and that a preliminary hearing is expected July 3.

According to the Idaho State Police, a dispute between Kaylor and his neighbors eventually resulted in him slaying 65-year-old Kenneth Guardipee, 41-year-old Kenna Guardipee, 18-year-old Devin Smith and 16-year-old Aiken Smith. Examinations by the Shoshone County Coroner’s Office found that the victims died as a result of homicide via gunshot.

Police were called to the scene at the 500 block of West Brown Ave in Kellogg, Idaho, at around 7:20 p.m. June 18. They have also obtained video footage of the shooting.

“This is a tragic situation that will affect the Kellogg community. Detectives continue working to establish a timeline and what led to the shooting,” District 1 Investigations Lieutenant Paul Berger said June 19. “As this case will go through the judicial process, we are ensuring every angle is covered with a thorough investigation.”

CBS News reported that Kenna was Kenneth’s daughter, that Devin and Aiken were her sons and that they lived in the bottom unit of a duplex, while Kaylor’s family lives in the top unit.

Citing a criminal complaint, the outlet said that “a few days before the shootings, Kaylor’s wife Kaylie posted on Facebook saying that 18-year-old Devin Smith was standing in front of his bedroom window, masturbating in view of her and their young daughters who were playing outside.”

Police recommended that Devin Smith be charged with indecent exposure, a misdemeanor.

“We responded to the call, investigated the call, and the report was done that day and submitted to the prosecutor’s office for charges,” Kellogg Police Chief Paul Twidt said of the incident. “I stand by what my officer did, and he did everything he could at the time. Nobody could have foreseen anything like this.”

Kaylor admitted to the killings when interviewed by authorities. He said that when he told Smith’s mother and grandfather about the exposure incident that they didn’t take it “seriously enough,” and that he “lost it” and “did something about it,” per CBS News.

“We see a crime which was committed in a relatively horrific manner in regards to the nature of the allegations, the manner in which it was carried out, and the method in which was utilized by the defendant in the course of his actions,” said prosecuting attorney Benjamin Allen of Kaylor’s case.

All victims were allegedly shot point blank to the head, except for Devin Smith, who was shot multiple times at close range.
