Allegheny Co. Sheriff files suit against council, executive

Allegheny County Sheriff Kevin Kraus has filed a civil lawsuit against the Allegheny County Council and Chief Executive Sara Innamorato in an attempt to block their efforts to impose a terms limits on himself and other county officials.

Council plans to put the issue on the ballot this fall as a referendum question through a change to its home rule charter.

Kraus' complaint says the state Constitution deliberately removed term limits for the Sheriff back in 1945.

The lawsuit argues the County is overstepping its home rule powers.

Attorney Tom King tells Marty Griffin on KDKA that Sheriff Krause and his legal team are 100 percent right here, council is overstepping its authority.

“This is something that affects every sheriff’s office across Pennsylvania and for that reason, Allegheny County Council does not have the unique authority to fool around with this, they can’t do something in Allegheny County that’s different . . . in the other counties in Pennsylvania,” said King.

King predicts the outcome of this case will have statewide implications.
