The defense for convicted Tree of Life shooter Robert Bowers is asking the court to exhume his father's body.

Bowers' team filed a motion Tuesday morning asking for the body of Randall Bowers to be exhumed from a cemetery in Shaler.

The trial is in the sentencing phase where jurors will determine whether or not Robert Bowers receives the death penalty or life in prison.

The main arguments for the defense have centered around Robert Bowers' family history, including mental illness on both his mother and father's sides.

In recent days though, the prosecution has questioned if Randall Bowers is truly Robert Bowers father.

The defense is asking to exhume Randall Bowers body to prove paternity. He died by suicide in 1979.
