A federal court ruling on Monday clears the way for several Beaver County school districts to move ahead with a lawsuit over the 2023 toxic train derailment in East Palestine, Ohio.
The ruling allows the districts to pursue damages, including funding for ongoing environmental testing and health monitoring.
Attorney Tom King's firm represents five districts with 10,000 students.
He told KDKA's Marty Griffin they will ask a jury to say the district should be compensated for long-term testing for exposure to dioxides and chemicals from the derailment itself and a following controlled burn.
“They need to have a baseline so we know what they’ve been exposed to, if anything, and whether or not it’s affecting them,” said King.
The districts King is representing are: Beaver, Western Beaver, Blackhawk, South Side and Ambridge.
