Illegal immigrant in Mt. Washington accused of assaulting ICE officer

Federal prosecutors say an undocumented alien living in Mount Washington has been indicted on charges he tried to assault an ICE officer while he was being taken into custody in December.

33-Year-old Darwin Davila-Perez was being sought by ICE after learning he had attempted to buy a firearm.

As a Nicaragua national with no legal status, Davila-Perez would be prohibited from buying a gun.

Prosecutors say when ICE encountered him in December, he backed his vehicle into a law enforcement vehicle with the officer inside.

They say he also tried to take the officer's gun, bit the officer as well as hitting that officer in the forehead with a swinging handcuff.

That officer then required medical attention.

If convicted, Davila-Perez faces up to 20 years in prison and fines up to $250,000.
