
A few days before Christmas Oakmont Bakery's Marc Serrao was accused of retail theft.
A Walmart employee alleged Serrao failed to scan multiple containers of strawberries at a self-checkout at the company's Frazer Township location.
Serrao was later charged with several counts of retail theft.
Attorney Michael DeRiso subpoenaed security video from the store and says the evidence shows the allegations were not true.
“We got corporate Walmart involved, they have local council and after speaking to him and showing him some of the videos, the charges were withdrawn,” said DeRiso.
On the Big K Morning Show, DeRiso said of the nine counts against Serrao, he actually overpaid for fruit in two cases. He says the Walmart employee "made up" the theft allegations.
“There were a lot of Facebook posts and stuff, people that believed that I would steal strawberries from a store like that,” said Serrao.
DeRiso says he received several phone calls from people accusing the employee of a “fair amount of dishonesty.”
