WASHINGTON (KMOX) — The Department of Justice backed a district court ruling Monday deeming the Affordable Care Act — often referred to as Obamacare — unconstitutional.
In the beginning, the DOJ wanted to get rid of the part of the ACA pertaining to preexisting condition protections, but it is now going after the entire law.
“The Department of Justice has determined that the district court’s comprehensive opinion came to the correct conclusion and will support it on appeal,” Kerri Kupec, a spokeswoman for the Justice Department, told the
Washington Post.
In December, U.S. District Court Judge Reed O'Connor of Texas labeled the law's individual mandate unconstitutional and used that to determine the entire law unconstitutional.
