Judge clarifies judicial order City of St. Louis is using to block future firefighter promotions

ST. LOUIS (KMOX) - A judge was asked to clarify a temporary restraining order the City of St. Louis is citing when blocking promotions within the St. Louis City Fire Department.

A group of St. Louis City firefighters suing the city over filling leadership vacancies in an acting capacity without proper pay are asking a judge to clarify their temporary restraining order.

The September order says all existing vacancies cannot be filled when a new list is certified.

However, the City is interpreting this order to block any future vacancies from being filled until the lawsuit is concluded.

Attorneys representing a group of firefighters suing for back pay over filling vacancies in an acting role argue the temporary restraining order should only mean only those vacancies cannot be filled while this lawsuit progresses.

The judge agreed with them and their understanding, going as far as to say his order doesn't halt all promotions, just the ones they are claiming they are entitled to.

What is unclear is if the city has changed their position. The City Counselor's Office has until Jan. 21 to respond to this motion.

The civil suit at the heart of this temporary restraining order has a trial date tentatively set for July 28th.
