St. Louis Circuit Attorney responds to AG's legal effort to remove her from office

St. Louis Circuit Attorney Kim Gardner has filed her response to Attorney General Andrew Bailey's Quo Warranto petition. The AG has alleged "willful neglect of duty" in his attempt to remove Gardner from office.

In the filing late Tuesday night, Gardner denies Bailey's allegations on issues of bond hearings, staffing, and filing and resolving criminal cases.


At the start of her answer, the Circuit Attorney disputes the jurisdiction the petition was filed in and questions the format of the AG's filing under Missouri Rules of Civil Procedure.

On some of the core issues raised in the Quo Warranto petition, Gardner questions statistics and news articles used by the Attorney General, alleging they are inaccurate. The Circuit Attorney also questions assertions made by the AG about obligations to notify victims of crimes.

Bailey called for Gardner's ouster after a visiting teen was critically injured in a downtown crash. The driver charged in the case had repeated violations of his bond conditions.
