Proposition B remains on April ballot after stay was granted by appeals court judge

ST. LOUIS (KMOX) - A St. Louis County judge ordered on Tuesday the removal of a ballot measure off the April 8th municipal ballot that would've given the St. Louis County Council the power to remove department heads.

However, hours after a Circuit Court judge ordered Proposition B removed from the April ballot, the Missouri Court of Appeals reversed the ruling, placing it back on the ballot.


Proposition B asks St. Louis County voters if the County Council should have the power to remove department heads.

Circuit Court Judge Bruce Hinton originally deemed the ballot language to be misleading, insufficient and unfair amongst other criticisms. The ballot language was also deemed argumentative, prejudicial and inaccurate.

The St. Louis County Board of Elections had been ordered to remove the proposition by 5 p.m. Tuesday before an Appeals Court ordered it return.

Last week, six different St. Louis County directors sued St. Louis County to halt Proposition B from appearing on the April 8th municipal ballot.

The six directors say the suit was a last resort and that continued interference by council members is intimidating and offensive and for the thousands of employees that work with them.

St. Louis County Executive Dr. Sam Page, who has been a staunch opponent of the measure, previously calling it 'a power grab', released a statement, calling Proposition B 'a ridiculous proposal.'

St. Louis County Councilman Dennis Hancock says County voters should not be denied a chance to weigh in on this issue.

"If other don't feel that way, then I don't understand why they wouldn't want to listen to the voice of the people," said Hancock.

Hancock says he is not sure if there is enough time for an appeal to the Missouri Supreme Court.
