Former President Donald Trump's indictment is unprecedented — that means there are a lot of unanswered questions. How will judges keep control of media coverage? Will the indictment affect Trump's 2024 campaign? How will his experience differ from everyone else's?
CBS Legal Analyst Thane Rosenbaum joined KMOX to share his insights. One thing we do know, he said, is that there won't be a perp walk for Trump — he's reportedly not even going to be handcuffed. Overall, he said, Trump's experience at the arraignment will be fairly anticlimactic — but his supporters on the outside might not be so mellow.
"He's gonna have a problem outside the courthouse because, you know, we have no idea how many people are going to show up in protest," Rosenbaum said. "On the other hand, given what happened on January 6, and the fact that so many of those people are still in jail, I can imagine a number of people staying away thinking, 'Clearly, no matter what we do, if we're supporting Donald Trump, we might get arrested.'"
As for the timeline of it all, Rosenbaum says there's "not a chance" that the case would be heard in court before the election.
"This case is on an infinity track," he said. "There's gonna be a lot of pretrial motions, you know, from change of venue to speak of, maybe recuse the judge — remember he's the same judge that already presided over a case over the Trump Organization just a year ago — change of venue to get it out of Manhattan, if nothing else to another borough like Staten Island, which is a little more conservative, possibly motion to dismiss, you know, picking a jury, good luck in this city."
