
BRIDGETON, Mo. (KMOX) - A man and his wife are suing a QuikTrip in St. Louis County after the woman claims she slipped on a banana peel that was left in the parking lot.
The lawsuit states that on Nov. 28, 2016, Julie Hart parked her vehicle at the QT on 11444 St. Charles Rock Road and upon getting out, stepped on a banana peel. It "caused her to suffer severe bodily injuries to her left hip and leg" which resulted in more than $200,000 of medical and hospital expenses.
Hart needed "numerous surgeries including the repair of a torn labrum and two total left hip replacements" after the incident, according to court documents. The lawsuit says she incurred lost wages of more than $10,000
and damages of more than $25,000.
James Hart, Julie's husband, is also listed as a plaintiff in the lawsuit because he "has lost the consortium, companionship, comfort, instruction, guidance, counseling, training and support of his wife." The lawsuit says he also incurred damages of more than $25,000.
Documents says QuikTrip was "negligent and failed to use ordinary care by not maintaining the QuikTrip in a reasonably safe manner and by failing to regularly inspect, maintain and clean its parking lot.”
The lawsuit was filed by attorney Timothy P. O’Mara on April 19, 2021 – nearly four years and five months after the incident allegedly occurred.
