Court rules against AG Schmitt's lawsuit to ban mask mandates in Missouri schools

JEFFERSON CITY (KMOX) - Missouri Attorney General Eric Schmitt has lost his injunction to ban mask mandates in all public schools.

The court also ruled against Schmitt's motion to apply class action status to the case against Columbia Public Schools, according to the Missouri Independent.


In August, Schimtt filled a lawsuit against school districts that force students and teachers to wear face masks. The suit called the mandates are "arbitrary, capricious and unlawful."

The ruling allows the lawsuit against the Columbia School District to move forward, but not the mask injunction. The mandate remains in effect. At the time, many schools in the St. Louis area had already announced mask mandates for all students and staff, regardless of vaccination status.

The Attorney General's office released this statement after the ruling:
"Our lawsuit against the forced masking of school children will continue. We plan to aggressively pursue discovery in this case to show how bureaucrats have incessantly moved the goalposts to justify never ending restrictions and mask mandates - the people of this state have had enough, and we plan to continue to seek answers. It's crucial that the Court ruled that schools fall under the new state law in his denial of the motion to dismiss, and while the Court denied temporary relief, this fight is far from over."

Last week, Schimtt announced another victory in his lawsuit to ban mask mandates in St. Louis County. St. Louis County Circuit Court judge Nellie Ribaudo denied the motion by St. Louis County Executive Dr. Sam Page to have the lawsuit dismissed.
