(KNX 1070) - LA County's Department of Child Family Services is facing a new lawsuit over claims they're to blame for doing nothing to prevent a child's murder.

The father of three-year-old Damien Ventura blames LA County's Child Family Services for his son's death.

Back in January 2017, he says he came to them with a video where Damien says he is being punched by his mom's boyfriend.

"So the video, they didn't believe me. I don't know what kind of proof they wanted," Oscar, the father said.

Six months later, Damien died with bleeding on the brain and since then the mother's boyfriend has been charged with Damien's death.

He has filed an intent to sue against Child Family Services.

They say the video report of Damien saying he had been punched should have been followed up by a visit with a forensic child psychologist to determine f the claim was credible.

In a statement to KNX,  DCFS says: "it has more than 34,000 children served by approximately 4500 social workers."

The department says it "continues to evolve its practices to effectively engage vulnerable children and families."
