Scott Peterson, who was sentenced to death for killing his pregnant wife 20 years ago, has been moved off death row more than two years after the California Supreme court overturned the death sentence.
Corrections officials shared on Monday that Peterson, 50, was moved from the San Quentin State Prison to Mule Creek State Prison, according to The Associated Press.
Peterson was charged and convicted of the first-degree murder of Laci Peterson, 27, and second-degree murder of the unborn son they wanted to name Conner. Peterson dumped their bodies into the San Francisco Bay on Christmas Eve 2002 after killing them.
After convicting him on the charges, the jury imposed the death penalty, but the state’s Supreme Court overturned the sentencing in August 2020.
The California Supreme Court made its ruling after it found that potential jurors were improperly dismissed for saying they personally disagreed with giving out the death penalty, but would be willing to follow the law and impose it.
Peterson could receive a new trial after the justices separately said a biased juror may have tainted his trial. Superior Court Judge Anne-Christine Massullo is considering the action after being tasked by the state’s high court with deciding whether or not he received a fair trial.
Peterson was being kept at San Quentin during the hearing process so he could have better contact with his attorneys.
