In an unusual announcement on Sunday, the United States Supreme Court shared that it would be releasing one opinion on Monday, meaning a decision on whether or not former President Trump can remain on the ballot could be coming.
The case brought before the court comes from Colorado, which challenged that under the 14th Amendment’s insurrection clause, the former president is not eligible to be on the ballot.
The announcement from the Supreme Court is unusual as the high court doesn’t typically announce in advance which decisions it will deliver, so a plethora of cases could be settled on Monday.
Still, speculation around the announcement has led many to believe the case being decided on is Trump’s ballot challenge, being that Tuesday is Super Tuesday, when primary voters across the country, including in Colorado, cast their ballots to choose their party’s nominee.
The court also shared that the justices “will not take the Bench” on Monday for the opinion announcement, despite that generally being what the court has done since returning from the pandemic.
Colorado’s case against Trump is now just one of many in states where prosecutors, state attorney’s generals, and political opponents have challenged that the former president is ineligible.
Still, after oral arguments last month, justices on the high court seemed like they were not reluctant to remove Trump from the ballot.
Opinions can be given starting at 7 a.m. PST.
