‘Locked door’ auto burglary loophole targeted in proposed law

If someone steals something from an unlocked car in California, it’s legally not auto burglary.

Under existing law, the district attorney has to prove that the door was locked for it to be considered auto burglary. California State Senator Scott Weiner said that this loophole needs to be closed.


“This is ridiculous, even if you have evidence that there was forcible entry,” he said.

The bill, SB 905, will mean that evidence of forcible entry will be enough for a district attorney to prove auto burglary.

The original locked car loophole has been in the California penal code since 1947.
