Attorney likens Bob Lee's autopsy to 'Walgreens of recreational drugs'

SAN FRANCISCO (KCBS RADIO) – The defense attorney of Nima Momeni has spoken on the death of Cash App founder Bob Lee, sharing some strong words surrounding the circumstance of the murder.

Momeni is accused of fatally stabbing Lee over a dispute related to Momeni's sister. He was scheduled to have his charges formally read to him on Tuesday, but the arraignment was postponed for a third time.

On Monday, Lee's toxicology report was released by the San Francisco Medical Examiner's Office, revealing that the tech executive died on the operating table and had alcohol, cocaine and ketamine in his system.

"Didn't I say last week I thought there were going to be a lot of drugs," Momeni's attorney Paula Canny stated. "There's a lot of drugs in Bob Lee's system. I mean Bob Lee's system is like the Walgreens of recreational drugs."

"What happens when people take drugs?" She added. "Generally, they act like drug people, and what do drug people act like? Not themselves. Not happy-go-lucky, just kind of loser-y and make bad decisions and do bad things."

District Attorney Brooke Jenkins said her team is ready for a defensive strategy that may try to use that report.

"I have not reviewed the autopsy report myself yet," she said. "At this time, I will speak hypothetically that we are accustomed as prosecutors to having the reputations of our victims be denigrated by the defense. That is a customary defense tactic."

Jenkins said the delays from the defense are also a tactic, though it's unusual to see these sort of delays pre-arraignment. The judge granted the continuation to May 18.
