ARLINGTON (1080 KRLD) - A Tarrant County grand jury has indicted Arlington Police Officer Bau Tran on a charge of criminally negligent homicide.

On Sept. 1, 2018, Officer Tran allegedly opened fire on suspect O'Shae Terry, 24, as he was trying to flee from police during a traffic stop. Terry died during the incident.

Terrance Harmon was a passenger in the vehicle with Terry. Harmon was not injured. After the indictment, he said, "I think of him every day. Every day. Not a day goes by that I don't think of him."

Tran had been on restricted duty since the shooting. Following the indictment, he was placed on leave pending conclusion of the administrative investigation. Attorney Lee Merritt represents Terry's family. He said the action against Tran does not go far enough, "The city of Arlington still has not made the proper decision in terminating his employment, and doing whatever it takes to make this family whole again."

Terry's mother, Sherley Woods, also spoke at a Wednesday news conference. She said, "In this situation, and in this case, there was no reason for Officer Bau Tran to shoot my son, O'Shea Terry, at the time he chose to do so. I feel that his life has been taken for no reason."

Tran is an eight-year veteran of the Arlington Police Department. Arlington Police said they will consider the grand jury's decision as a factor in the internal investigation.
