Buc-ees Sued For Having Low Gas Prices In Alabama

DALLAS (KRLD) - Buc-ees is facing a lawsuit in Alabama, at its new location, because their gas prices are too low.

The lawsuit alleges the Texas-based convenience store chain priced its gasoline at an unfairly cheap rate that harms competitors and violates the Alabama Motor Fuel Marketing Act. When Buc-ee's opened its new location it set the price of gas at $1.79 violating the act by selling for under $2, according to the complaint. 


Dallas civil attorney Rogge Dunn, who is not affiliated with the suit, says this is a classic allegation of predatory pricing.

"The issue is, is the pricing below your cost or below what its generally being sold for, in an effort to drive out your competition," Dunn says.

He says usually when the competition has closed shop, the bigger company will raise their prices. 

Buc-ee's also plans to open another location outside of Texas this year in Daytona Beach, Florida.

In a statement, Buc-ees says they strive to give their customers the best experience, "including high-quality fuels, priced fairly and competitively."
