
BALCH SPRINGS (1080 KRLD) - A U.S. Magistrate is recommending the civil suit filed against Balch Springs for the shooting death of 15-year-old Jordan Edwards by a police officer be dismissed.
In a 28-page ruling, Magistrate Rebecca Rutherford is recommending Chief District Court Judge Barbara Lynn "...grant Defendant the City of Balch Springs’s Motions to Dismiss and dismiss Plaintiffs’ claims against the City with prejudice." the recommendation says.
"Additionally, the Court should deny Plaintiffs’ requests to further amend their Complaints."
Legal experts say Judge Lynn does not have to accept the recommendation, but that the Magistrate's ruling carries a lot of weight.
"Judge Lynn, I'm sure, is going to go through the reasoning and findings in Judge Rutherford's recommendation to see whether it should be the order of the District Court," said KRLD Legal Analyst Ed Klein.
The recommendation points out there have already been three amended suits after the origional was filed and says any future amended complaints "would be futile."
