Harris County Judge May Have Accidentally Resigned

HOUSTON (KRLD) - Supporters are hoping a Harris County judge will get to keep his seat. 

Democrat Bill McLeod, who's only been on the job for a few months, posted plans online to run for the Supreme Court of Texas. 


And then he was told about Article 16, Section 65 of the constitution which says any county court of law judge who publicly considers candidacy for another office has to resign.

Supporter Daniel Cohen hopes that doesn't happen. 

"This is an arcane part of the Texas constitution that would potentially trigger a series legal options that would allow for the will of the people to be overturned, and that's not the right way for us to do government."

Under the Texas constitution, county commissioners have the authority to let McLeod keep his seat as a holdover and run again for his seat on the bench at Harris County Civil Court at Law Number Four. 

Cohen stresses McLeod made a simple mistake and notes wants the county commissioners to let him stay. 

"We need to make sure we're upholding the spirit of the law and that the will of the people is respected.  I think that really important values, democracy, fairness and equity are all on the line."
