WACO (1080 KRLD) - Nobody will be prosecuted for the massive Waco, biker shootout that happened four years ago.
McLennan County District Attorney Barry Johnson has dismissed all charges.
In May of 2015 rival gangs got into a shootout at the Twin Peaks restaurant in Waco. Police had suspected trouble and were there.
Nine were killed 20 wounded and 177 arrested and held on a million dollars bond.
Assistant District Attorney Tom Needham said there were "dozens of other charges" that could have been pursued. However, Needham says the statute of limitations has run out on charges such aggravated assault, attempted murder and illegal posession of weapons.
Murder was all that was left.
"Having reviewed all of the evidence we feel there is insufficient evidence to prove beyond a reasonable doubt, murder against any individual that was there." he said.
Out of nine who were killed, five were shot by police officers.
"I think this the correct decision by the new DA." said criminal defense attorney Toby Shook, who represented two of the bikers. "I commend Barry Johnson for having the guts and the wisdom to make that decision."
Shook says he's never been involved in a case like it, where over 170 have been indicted, and none prosecuted.
