
Convicted serial killer Billy Chemirmir is appealing one of his capital murder convictions.
In a filing to the US 5th Circuit Court of Appeals, Chemirmir is appealing for the first of two capital murder convictions. In this case Chemirmir was found guilty of smothering Lu Thi Harris in her home.
Court records show Chemirmir was put at the area of the crime partly on the testimony of an FBI expert in cell phone use. But appellate attorneys say agent Mark Sedwick's data was misleading.
Dallas County prosecutors landed the capital murder conviction in this trial and in a second case, giving Chemirmir no chance to get out of prison.
Prosecutors dropped 11 other capital murder charges in Dallas county alone.
Chemirmir still faces four pending capital murder charges and two attempted murder indictments in Collin County.
