Dallas shooting victim dies, charges against suspect will likely be upgraded to murder

Charges may soon be upgraded to murder with Sunday's death of a Dallas shooting victim.

Police reports say the shooting was in Uptown Dallas late Friday night. The victim was found badly wounded in his pick-up truck that crashed on Fairmount Street near Woodall Rodgers.

A man named John Luster was quickly arrested on a charge of aggravated assault with a deadly weapon. But with the victim's death, police say it's likely Luster will be charged with murder.

As of Tuesday morning, the charge remained aggravated assault. Luster was caught because the victim was on the phone with 9-1-1 at the time saying a man had pulled a gun on him. He was able to give the gunman's license plate number to the dispatcher before he was shot. Then the dispatcher heard several gunshots over the phone.
