Former Dallas police officer Amber Guyger has lost her appeal.
Guyger has been convicted of murder. Her attorneys argued there was insufficient evidence to convict her of murder and had asked the Fifth District Court of Appeals in Dallas to either acquit Guyger or make a finding of criminally negligent homicide.
Guyger claimed she went into Botham Jean's apartment by mistake and thought he was an intruder when she shot him.
Attorney Michael Mowla argued questions remain about her conviction.
In the ruling the court found that Guyger acted unreasonably, and saw no reason the jury's verdict shouldn't stand.
Guyger can now appeal to the Texas Court of Criminal Appeals.
