Opponents of the planned high-speed rail line between Dallas and Houston, now believe that they can stop the project.
On Friday the Texas Supreme Court announced that it will hear a case on the issue of eminent domain.
The court initially let a lower court ruling against the opponents stand.
Some landowners along the path of the train do not want to sell their property and argue that developers have no legal right to take it.
Arguments in the case are set for January.
