Keller (1080 KRLD)- A former Keller Police Officer has been indicted by a Tarrant County Grand Jury, accused of having used excessive force during an arrest last August.

Per NBCDFW, former sergeant Blake Shimanek ordered an officer to arrest and pepper spray Marco Puente, who was filming the arrest of his son Dillon during a traffic stop. Both Marco and his son were subsequently taken to jail but later released upon reviewing the charges.

In January, Marco filed a lawsuit in federal court in Fort Worth. Their case alleged that the officers used excessive force, made an illegal arrest, and claimed that Dillon was targeted because he was Hispanic and that officers wrongly believed that he possessed drugs in his car.

A settlement of $200,000 was agreed between the city and Puente.

Shimanek was subsequently demoted and went on to resign in February.

Following this Friday's indictment, Shimanek faces up to a year in jail and a fine of up to $4,000 on charges of official oppression.
