New Fort Worth city council to decide what to do with lawsuit by former Police Chief Fitzgerald

It's going to be up to the new Fort Worth city council to decide what to do about a lawsuit by former police chief Joel Fitzgerald.

Fitzgerald claims he was wrongly fired for blowing the whistle on Fort Worth Police department's alleged improper use of computers tied into the FBI's system.


Fort Worth officials say he was fired for performance issues.

Fitzgerald's lawsuit was heard in a Dallas County court where Fort Worth moved to have the complaint dismissed on grounds that Fitzgerald did not follow the city's internal grievance procedure.

A trial judge dismissed part of the lawsuit, but an appeals court overturned that and kept the entire complaint in tact.

Now the Supreme Court has refused to hear the case.

Fort Worth has the option of asking for a re-hearing but it will be up to the new Fort Worth city council to decide whether it wants to press ahead and continue the fight.
