Dallas, State Fair of Texas face deadline to respond to Paxton's appeal of gun ban decision

Attorney General Ken Paxton (R) has filed a notice of appeal after a court denied his request to halt a gun ban at the upcoming State Fair of Texas.

Paxton's office announced plans to take the case to the newly established 15th Court of Appeals, based in Austin. The court, created by the Texas Legislature to handle appeals involving the state and challenges to the constitutionality of state laws, is comprised of three justices appointed by Gov. Greg Abbott (R).


The court asked the city of Dallas and the State Fair of Texas for a response by Tuesday at 12 p.m. The city owns Fair Park, where the fair is held.

With the fair set to open on Friday, Paxton hopes to have a ruling by the appeals court in time to appeal to the Texas Supreme Court if necessary.

It's not clear if oral arguments will be necessary.

The fair implemented a gun ban after this year after a shooting at last year's fair that wounded three people. Paxton, representing a group of Texas House Republicans, said citizens cannot be deprived of their lawful right to carry firearms.
