
The Texas Court of Criminal Appeals today declined to hear the death penalty case of convicted cop-killer Brandon McCall of Richardson.
Without comment, the highest criminal court in the State has refused to hear arguments in McCall's appeal. On February 7, 2018, McCall killed a man named Rene Gamez at an apartment complex in Richardson.
Court records show McCall then waited in ambush for police to arrive. The first officer through the door of the apartment was Richardson Police Officer David Sherrard. He was immediately shot and killed.
McCall was eventually arrested, convicted of capital murder, and sentenced to death. Then-police chief Jimmy Spivey had officers lead McCall out of court in officer Sherrard's handcuffs.
McCall still has other avenues of appeal that are automatic. The case now moves to the federal court system where rulings can typically take years.
