The question of whether Texas can force the entire nation to shut down DACA is now before the 5th Circuit Appeals Court.
Texas is challenging, DACA, which is meant to protect children who may have been brought into the country illegally, but have grown up here. Texas says they harm the state. A judge has blocked Texas from doing that until the case can be litigated. Texas lawyer Joseph Mazzarra told a judge the injunction should apply nationwide.
Department of Justice lawyer Brian Boynton responded, "It is absurd that Texas thinks that it could shut down DACA in every state across the country based on injury to Texas."
The 5th Circuit took the question of lifting the injunction under advisement but the injunction is expected to remain in place until the U.S Supreme Court can hear the case.
