Brentwood Police in Northern California said no local charges are pending after they found a mannequin hanging from the side of a home with a sign across its chest reading "Sleepy Joe" and the word "Cheater" in parenthesis.
Someone reported the mannequin Thursday morning.
Officers found the effigy, clothed and wearing a black hat, hanging from a rope off the side of a two-story home. Several posts on social media denounced the mannequin, one showing the home draped in Trump flags, American flags and signs. President Trump has often referred to his Democratic rival Joe Biden as "Sleepy Joe" throughout the campaign.
The homeowner agreed to take down the mannequin.
According to a Facebook post, police said they were told by the Contra Costa District Attorney’s Office that the act was not criminal, as it is protected under the First Amendment.
Police have forwarded their investigation on to the U.S. Secret Service.
