A jury last month could not come to a verdict on two of the three counts against 62-year-old Frank Nucera. They did, however, convict him on a charge of lying to the FBI.
Judge Robert Kugler intends to sentence Nucera on that one guilty count in early February. A tentative date for retrial on the assault charge and a related hate crime accusation was set for March 16, but could be changed.
