Pa. attorney general will appeal judge's decision to overturn Spanier conviction

PHILADELPHIA (KYW Newsradio) — Pennsylvania's attorney general says he will appeal a decision by a federal judge overturning the conviction of former Penn State President Graham Spanier in the Jerry Sandusky scandal. 

Spanier was convicted two years ago of endangering the welfare of children. He was sentenced to at least two months in prison plus two months of house arrest.

But a day before Spanier was to report to prison, a federal judge tossed his conviction, ruling it was based on changes to the law that took effect in 2007 — six years after the conduct in question. 

In a statement, Attorney General Josh Shapiro said "no one is above the law." He said he will quickly appeal the ruling to — in his words — hold Spanier accountable for his conduct covering up child sexual abuse.
