
Goochland County, VA _ A Goochland County woman and four gun rights groups are asking for a temporary injunction to prevent the one handgun a month law passed by the 2020 Virginia General Assembly from taking affect on July 1st.
Lawyers for Valerie Trojan, Brothers N Arms Inc., Virginia Citizens defense League, Gun Owners of America Inc., and Gun Owners Foundation, are asking for a declaratory judgement declaring the limiting of handgun purchases to one a month to be in violation of the Virginia Constitution. They're also asking for both temporary and permanent injunctions to prevent Virginia State Police from administering or enforcing the law until all ongoing legal challenges are decided.
The suit, which names State Police Superintendant Colonel Gary Settle, "infringes on the right right of the people to keep and bear arms", and is therefore unconstitutional.
Virginia Attorney General Mark Herring, in a statement, says "Previously, the one-handgun-a-month law was in place in Virginia for nearly 20 years and proved to be extremely successful in keeping a large number of firearms off our streets. Both this law and the other gun violence prevention measures that were passed during this year’s legislative session are constitutional and Attorney General Herring is prepared to go to court to defend their constitutionality."
A hearing is tentatively scheduled in this case for Thursday, June 25th at 3:00 PM.
