Richmond, Va. (Newsradiowrva.com) - Three days into his administration, Governor Glenn Youngkin has been sued by a group of 13 Chesapeake Public School parents. The lawsuit is over Executive Order Two, which starting next week would create an "opt out" for school mask regulations.
The lawsuit, filed with the Supreme Court of Virginia, argues the Order disregards state law, as well as constitutional powers granted to local school boards. The Northam Administration had maintained that the state law that required five-day in person schooling also required masks, although Republicans disagreed.
The parents are asking for the Order to be declared void prior to its effective date of Monday, saying they are likely to face irreparable damage if it goes into effect. Chesapeake Schools have not yet made decision on how they are going to handle masking beyond this week.
The lawsuit is also against the Chesapeake School Board, the Chesapeake Superintendent, and the acting State Superintendent and Acting State Health Commissioner. There is no word on when the Supreme Court will act.
