A federal judge said the University of Pennsylvania does not have to hand over lists of Jewish students and employees to the Trump administration, for now.
The judge had given Penn until this Friday to comply with a subpoena from the Equal Employment Opportunity Commission, which is investigating its own claims of antisemitism on campus. However, the judge granted Penn’s request for a stay while it appeals.
The judge wrote that the EEOC “has a substantial interest in investigating a valid charge of discrimination” and that “Penn does not have a strong chance of prevailing on appeal.” But, he said, Penn does make a narrow case for irreparable harm.
He said the EEOC won’t be hurt by waiting for an appeals court to hear the case.
A Penn spokesperson said, “Now that the stay has been granted, we can proceed with the appeal process.”
