The Electric Reliability Council of Texas (ERCOT), which manages the state's power grid, is already facing lawsuits over its handling of last week's historic winter storm, which included rolling blackouts that left some customers without electricity for several days.

However, it is still unclear if ERCOT has immunity from legal action.


SMU Law Prof. Eric Cedillo said the answer is expected to come from the Texas Supreme Court, which is considering a case that dates back to 2016.

Cedillo said the court will determine whether ERCOT, which falls under the authority of the Texas Public Utility Commission, qualifies as a governmental entity, shielding it from lawsuits.
