DENTON, Texas (NewsRadio 1080 KRLD/Talk1370.com) -- Texas Attorney General Ken Paxton is suing the city of Denton after it refused to remove its mask mandate in response to a letter from the Attorney General’s Office.

During a meeting on Monday, several members of the Denton City Council indicated they would base their decision on the mask rule on guidance from the CDC, not the Texas Attorney General.

"This council has pretty consistently referenced the CDC as our guiding authority on public health measures," Mayor Pro Tem Paul Meltzer said.

No one is above the law. No one,” Paxton said. “This sheepish attempt at defiance will be handled swiftly. The only ones who suffer in this repeated political theater are the great people of Texas. They deserve better.”

According to the Attorney General's office, the Denton mask mandate violates Texas Gov. Greg Abbott’s Executive Order GA-38, which prohibits governmental entities from forcing any person to wear a mask.

Paxton's office sent a letter to the city last week instructing officials to rescind the rule by 12 p.m. on Tuesday. That deadline passed without any action from the city council.
