CHICAGO (WBBM NEWSRADIO) - The parents of a pharmacist killed in a 2018 shooting at Mercy Hospital have settled a wrongful death lawsuit for $20 million.
Attorneys for the parents of Dayna Less said she chose pharmacy as a way to ease others’ suffering after she experienced chronic headaches as a teen.
The 24-year-old was engaged to her high school sweetheart when she was killed walking off an elevator at Mercy Hospital by a man who had just murdered his former fiancee , Dr. Tamara O’Neal, and a Chicago Police Officer Samuel Jimenez.
The lawsuit claimed Mercy, which is now Insight, as well as SDI Security failed to warn the pharmacy resident about the active shooter and prevent him from coming back into the hospital.
Lawyers said the settlement is a record in the state for a wrongful death case without any dependents.

“The record size of the settlement speaks to how special Dayna was as a person, the unique relationship she had with her parents, Brian and Teena, and the enormity of their loss,” said attorney Mark Dym, who represented the Less family.
