Fulton County DA Recused from Prosecuting Cop in Rayshard Brooks Death

Fulton County District Attorney Fani Willis is being granted a request she has rallied for since taking office earlier this year.

A judge has decided to recuse Willis from prosecuting Atlanta police officer Garrett Rolfe in the shooting death of Rayshard Brooks.

A husband and father of 4, the 27 year old Brooks was shot and killed outside an Atlanta Wendy's restaurant last summer.

DA Willis contended that her office couldn't handle the prosecution of the Rayshard Brooks death case because of actions by former DA Paul Howard.

Willis had made two requests to the Georgia Attorney General for another prosecutor to be put in charge of the case. AG Chris Carr denied both requests. Sworn into office in January, Willis claimed that the actions of her predecessor, Paul Howard, had made it impossible for her office to handle the case.

Just days after the shooting, Howard charged Rolfe with felony murder. He'd already been fired by the Atlanta Police Department.

The city's civil service board recently reinstated Rolfe, finding that he was not properly dismissed.  The oversight board's decision was followed by a statement from APD indicating that, while he's reinstated, Rolfe would be placed on adminstrative leave until the resolution of the criminal charges.

Brooks got into a struggle with officers after he was found asleep inside a car at the restaurant drive-thru.

The medical examiner determined that Brooks died from 2 gunshot wounds to the back.
