Dino Walker was being held in the Fulton County Jail in Atlanta when he was fatally stabbed last year.
Attorney Harold Spence, representing Walker's family, tells Audacy Atlanta
that they are filing a lawsuit against Fulton County and the sheriff's office "to hold them accountable for the abomitable situation at the jail."
Spence and Walker's family contend that the inmate was killed after a detention officer abandoned his post for an hour. They claim that the officer's absence left Walker unprotected.
Audacy Atlanta is awaiting a response from the Fulton County Sheriff's Office about allegations made in the complaint.
It is the latest lawsuit following ten deaths at the Rice Street facility this year.
The U.S. Justice Department launched an investigation into the jail earlier this year.
