(WBBM NEWSRADIO) -- Even though the star witness in a trial against an Uber driver was a no-show in a McHenry County courtroom Monday, the state's attorney says he will re-file charges as soon as the witness is located.

The former Uber driver is 29-year-old Ahmed Tawfeeq. He already sentenced to five years in prison for sexually abusing a female passenger in 2017, and State's Attorney Patrick Kenneally had hoped to try Tawfeeq for soliciting harassment of that passenger.
But a witness didn't show up.
"The case is far from dead. We had a witness who did not appear in court, irrespective of the fact that they were lawfully served with a subpoena. It looks like they might have fled out of state,” Kenneally said. “So, we're going to do our best to try to get a sense of where he is."
If Tawfeeq is convicted the additional offense, it could add years to his prison sentence.
An attorney for Tawfeeq says the state's witness made up the story about Tawfeeq wanting the woman to be harassed.
