Another Illinois Lawmaker To File Lawsuit Challenging Governor's Extension Of Stay-At-Home Order

ROCKFORD (WBBM NEWSRADIO) -- Another Republican state lawmaker plans to file a lawsuit challenging the legality of Governor Pritzker's extended stay-at-home order.

A judge in Clay County ruled against Pritzker on Monday in a similar lawsuit, and State Attorney General Kwame Raoul quickly filed a notice to appeal on the Governor's behalf.


The planned lawsuit by State Rep. John Cabello, of Machesney Park, differs from the one filed by downstate Rep. Darren Bailey. Cabello wants his lawsuit to cover everyone in Illinois, while Bailey's lawsuit only covered himself. 

"I want to see if what the governor is doing by extending his order is constitutional," Cabello said. "I think government has gone way too far by saying you are not allowed to be open because we say so."

Cabello said the Governor's stay-at-home order is creating economic winners and losers, with the winners like Target and Walmart and the losers being mom and pop operations. He said small businesses should be able to operate with safety precautions in place.

"We have businesses open today. If those businesses can follow the same guidelines to make sure the employees are safe, to make sure the people that are coming into the stores are safe, then I think they should have the right to be open," Cabello said.

"I'm not trying to put anybody in harm's way here. I'm just wanting to see that some of this stuff start's making common sense."

Cabello said he plans to file the lawsuit in Winnebago County.
