DuPage Prosecutors Won't Retry Man In Toddler's Death

(WBBM NEWSRADIO) -- A DuPage County man says it's time for him to move on with his life -- and start putting his family back together -- now that prosecutors have said they will not try him again for the 2002 death of a toddler.

"Today's my first real day of freedom after 17 years," Randy Liebich, 39, said Wednesday at a news conference.


He was 22 when he was first arrested for the murder of his girlfriend's 2 ½-year-old son.

"My family's been broke apart, but now it's time to move on with my life and start rebuilding those relationships," he said.

Liebich has been free since last fall, when a judge vacated his conviction, saying his defense lawyers in 2004 didn't present ample evidence that the child died of natural causes.

Now, DuPage County prosecutors say they don't have the evidence to try Liebich again. They note that doesn't mean Liebich is innocent.

Liebich commented on that: "They know what the evidence shows. They know."
