CHICAGO (WBBM NEWSRADIO) -- Twenty Chicago Public Schools students are waiting to see what will happen in the latest court action: Will they be allowed to compete in the state cross-country meet this Saturday -- and even if they are, will their times actually count?

The Illinois High School Association filed an appeal, meaning, basically, that it's sticking by its rules and wants to deny CPS cross-country athletes the right to compete at state because they did not compete at regionals during the recent teachers’ strike.

Now, a lawyer who represents the cross-country athletes, Kevin Sterling, says he's filing a response to the IHSA, arguing that the students should be allowed to compete this weekend at state.

"You got to have some thoughtfulness and compassion in the way you apply your rules,” he told reporters Wednesday.

After Sterling files his response, the court has five days to decide.

The immediate future of 20 CPS athletes hangs in the balance.
