CHICAGO (WBBM NEWSRADIO) -- Instead of celebrating their son's birthday this week, a Calumet City couple is suing their former daycare provider over his death.

Ebony Clark said she and her husband plan to release some balloons on Thursday when their son Tre would have turned one.

Attorney Heidi Wickstrom said an employee of Learn N Play All Day Home Childcare in Lansing found Tre unresponsive last month after he was napping unsupervised in the basement for two hours in a Pack and Play, a portable crib.

The baby was without oxygen for at least 20 minutes and no one attempted CPR or other life-saving measures, according to the lawsuit.

Wickstrom called Tre's death "horrific and egregious" and says it was entirely preventable.

Clark and her husband, Vincent Clark the third, are suing the daycare, its owner and staff.

WBBM has reached out to the owner, Kimberly A. White, and the Illinois Department of Children and Family Services for comment.
