CHICAGO (WBBM NEWSRADIO) -- The city of Aurora appears to be backing off its attempt to evict convicted sex offenders from a group home.Aurora sent eviction notices to 19 child sex offenders last month saying they had until this week to move out of Wayside Cross Ministries because it was less than 500 feet from a park. Mark Weinberg and Adele Nicholas, lawyers for the men, argued state law states “playground” not “park” and that the men live more than 500 feet from the “playground” at McCarty Park on New York Street.

The men challenged the move in federal court and now Nicholas said Aurora is backing off.

Nicholas: "We’re hopeful that this is moving us towards a resolution.

Reporter: "Sounds like the men will be allowed to live there?"

Nicholas: "Definitely for the time being."Nicholas said the 19 men are "relieved."In the end, Nicholas said the question is whether the Kane County State’s Attorney will push the eviction matter. She and Weinberg plan to discuss it with the state’s attorney’s office.
